Logic for Oct Retrogression

Let me know if my logic is reasonable for the Oct retrogression:

1. The proposal to end LC substitution is still pending at DOL. Recently it got approval from OMB
2. USCIS wants to stop approving and filing new cases until LC substitution is terminated
3. The best way until the proposal is finalized is retrogress
4. I don’t think there is really a reason to say visas are ‘U’navailable just during the beginning of the year. Instead they chose, arbitrary old dates
5. As soon as the LC substation proposal is approved, possibly by end of this year, the dates should be reasonably back

I think the opposite way. After Manila’s visa bulletin or today’s so-called official visa bulletin, many substitute labor certificates with 98/99 PD will be on the market or Ebay.com. We will see a similar situation to the amnesty of April 30, 2001 before substitute labor is finally eliminated. The substitute labor will survive at least several months for public comments/review. At the same time, people will dig out all 98/99 substitute labor certificates.

If I can find one myself, I will pay 20 grand as down payment and pay that employer to work there.

How about simpler Logic for Oct Retrogression:
Too many Indians, Chineese, Mexicans and Philipions applied/ got green cards in the last 5-7 years.
 
Reasons: My Guess

Here is my guess of reasons for unbelievable cutoff dates

1. DOS could not estimate the proper cutoff dates(as usual) and they don't
want to be Off by too much and end up putting "U" in certain catagories. Though these cutoff dates are as good as "U" they are not really "U" for those
that matters in the Gov. Also earlier DOS got burned themselves by providing
more numbers than they are supposed to in any particular quarter. So may be they are going to move the dates too much cautiously.

2. In last fiscal year (ending Sep 05) they already issued way too many GC's, especially for people from certain countries, over their annual quota(may be almost equivalent to 2 year's quota) that they may put reasonable cutoff dates only in last quarter of this fiscal year(starting from Jul 06).

Solution suggesstion to DOS:
Allocate a visa number when the application is filed. There are only very few applications that doesn't get approved or abandoned and they can easily rollover them onto the subsequent years. This way they don't need to do the complex(or illogical) demand estimation and put some arbitrary cutoff dates(the date for which no one qualifies).

WE WILL TOGETHER COME OUT WITH A COMMON LETTER

REMEMBER MANGAL PANDEY, REVOLUTION MUST BEGIN AT SAME TIME EVERYWHERE

SO IF SENATORS AND CONGRESSMAN RECEIVES LETTERS ALL OVER THE COUNTRY,
IT WILL BE BIG BIG EFFECT

Yes we should all unite and should be positive and think about what we should do next. Every one should send letters to senators, congress men who ever. I urge every one to be positive. We should get our green cards if every one unite and do something about it instead of sitting and cursing about it. Go Srini go lead us.
 
I dont think they are retrogressing just to wait for the substitute labor to be abolished. If that were so, EB1 should not have retrogressed.
Maybe they had all the case files hidden in New Orleans division, and probably Katrina flooded it :-(
