Local office won't process interim EAD! In dire need of advice!

On August 13, 2004 I applied for EAD renewal and managed to get the fingerprinting done on Nov 6th here in Los Angeles. But looks like my case (along with my 485 and I-130) are being processed in Missouri Service Center.

So anyways, now its been more than 90 days and I haven't received my new EAD. So I went to my local office (Los Angeles) where they refused to even listen to me! They said they cannot give me an interim ID because they don't have my file. Are they right? I talked to the supervisor there who told me the same thing. So basically I'm screwed because my current EAD expires in a week on the 25th! There's no way I'm gonna get my new EAD in time because it looks like the Missouri Service Center is way way behind in processing.

I had requested the LA office to have my case transfered to their office, back in June and I have a letter from them saying that they requested the transfer on July 8th. But they still haven't received my file.

Please provide any advice that you can. I have another appointment set for the 23rd in the LA office, but is there anything else I can tell them or show them to have them give me an interim EAD? If they are wrong, who do I go to or is there anything I can do?? The National Service Center can't do anything, I asked them already.

on a different forum somebody had the same story about Atlanta forum. Boy, I am very lucky - got my EAD within a month and a half from MSC.

IN theory, all you have to show is your notice of receipt for I-765....
 
Oh, man , I thought that only the receits for 485 , 765 etc are enough. Of course that they wont have your file, cos your actual 765 is processed in Missouri.
The reason for refusal they gave you just doesnt have any lawful ground. Just bring all your stuff and try again. Schedule an Infopass appointment before that thopugh and go with the printed copy of the appointment.
You might want to wait 1 more week for the actual EAD. I waited 100 days altogether.
 
Thanks for your responses! I do have another InfoPass appointment for the 23rd, 2 days before my current EAD expires! And this time I am also taking a letter from my company saying that I am crucial to the project I am working on. I really hope I get to talk to some other officer, the one I talked to yesterday was just plain rude. She wouldn't let me say anything else after she checked my receipt number and realized that my case wasn't in LA. I had her call her supervisor who basically said the same thing, that I can't get an interim EAD since they don't have my case.

I think you guys are right. this is rediculous.

You are suppose to be guaranteed an EAD within 90 calendar days.

If not then they must issue you an interim EAD.

This is a good opportunity to give your local congressman a call.

Ask to speak with a caseworker regarding INS.
