Is it legal for someone who is on H1B visa (sponsored by another company) to be an acting member of an LLC? Again 2 companies are seperate and the H1B visa work is not related to the LLC duties.
What is meant by an active member? LLC is not an org to be a member.
LLC is a business entity, envolving any activity with pay or with no pay is illegal unless you have another (concurrent H1) from the LLC company.

You can be a silent partner and draw profits or dividends depending on operating contracts through the LLC. You maynot function as a officer of the company
