So long as you have a means of returning to the US (valid AP or H/L) when the adjustment is approved, you can be outside the US for as long as you want.
TheRealCanadian,
Thank you very much.
I am employed with US company and working on H1B. I got project in England and my H1B will expire very soon. Our company attorney asked me to use EAD/AP instead of processing new H1B.
I was under the impression that AP is only for short trip and one can not stay outside for long time..
You can stay outside until the AP expires. You will need to be physically present in the US to apply for a new one, so I wouldn't stay in England too long without an H-1B. It's cheaper for everyone to get you an H-1B for 3 years than mess with constant AP renewals.
I stayed out of USA with 485 pending for two years , working for an American Company. It was OK and I came back to the States to renew my AP, came back and forth. No problem.
GCnofun, do you stay in US to wait the new AP approval before you leave again or you just left once you file the new AP without waiting for the approval.
I would appreciate it if you can share more on this.
I have done it. Actually , My lawyer is US lawyer (sorry if I did not make it clear). After receiving the approval, he mailed the approval to me while I was outside of the country. I then took the AP for traveling back to the States.
