lived in Canada, can I recapture?

hello:
I lived in Canada for 10 months. I went there on an official trip for a project
while I was still working for a US company(based on H1 visa). I was being
paid in US dollars from this US based international company.

Can I apply for recapture of that 10 month period? My concern is, since my H1
visa was still active during those 10 months, I might have problems later during
green card time. I heard that even though INS might allow me to recapture
this time for now, later on, if it finds that myH1 visa was active during those
10 months, INS may cause problems in the final stages of my green card.

is this true, any feedback, please.
thank you very much.

Since you were paid in US$ and were in your US company payroll I do not think you will be able to recapture this period but people have gotten lucky many times when such periods of time have been recaptured.Consult more than one lawyer ,unless you have got a very good one ,before you decide.

This is not legal advice
