Can you get a license in NY state with EAD card and an expired I-94?(and with the 6 points required for proof of identity,of course).(status is: Adjustment of Status-awaiting interview for I485)

Last week I got the letter stating that I am not eligible for SNN yet(before getting my EAD card..which I received on Friday). Can I use that letter?

No. You need your Social Security Number to be able to work anyways...

Apply for SSN. (bring Passport, EAD, I-485 Receipt)
Wait and receive SSN.
Go to DMV and apply for Driver's License (bring EAD, SSN, Passport, I-485 Receipt).

FROM THE NEW YORK DMV WEBSITE:

Note 1: If you are not eligible for a Social Security Card, you must provide a letter or form SSA-L676 from the US Social Security Administration (SSA) that states that you are not eligible.

BUT YOU ARE ELIGIBLE... you would be lying by presenting that letter, you are NOW eligible... go get your SSN (which you will need to start working also).

I think Praetorian is right. You applied for SSN before you got EAD, therefore you weren't eligible. Now you are.

You should try to get your SSN now IMHO.

I personally do not have EAD yet, but I have had a SSN since I was a student in 2002. So I got Drivers license as soon as I got NOA on EAD (just last month). The SSN is important even to work.

But try it your way, this is just what I would do.
