letter from USCIS and infopass both conrtadicting info

My PD is Aug 2001 and I filed my 485 somewhere in July 2003.

Now when June visa bulletin came out, I called USCIS to find the status of my case and Lady took all information and give me case number. She said since your case was files in july 2003 and now NSC is processing date is somewhere in 2006, let me initiate query about case status - outside processing time.

I took infopass appointment next day to findout status of my name check. officer told me that my case is stil lpending in name check. Contracted senator almost 2 months ago but no reply from him yet.

Now today I received letter from USCIS .

" Your case is pending visa availability. When a visa becomes available , your case will be processed. You may wish to refer to visa bulletin to see when your visa becomes available. Your case will not be processed unti a visa is available"

Now what is this? which one is correct? I guess letter which I received from USCIS has same format which everyone gets whether their case is pending in name check or not.

If anyone has similar situation please share your experience.

If you are from India then they both could be correct.
I saw my case info printout from uscis internal database.
That info is basically what the INFOPASS officer sees. There is no information about retrogression or visa bulletin.
There is an information about initiation and completion of checks.
So, if the officer saw that there is no info about NC competion, then he told you that you stuck in the namecheck.
and if you are from India, then people in the service center saw that you are retrogressed in your file and you get the answer about visa availability.

Also I received RFE somewhere in last last July. Attorney replied to it and online message changed that they received RFE. does it mean that my case is preadjudicated?

May be. But what difference does it make for you if you stuck in namecheck?
+1 month, -1 month is not a long time comparing with your waiting time.

I'm also stuck in namecheck since August 2003
and I wasn't retrogressed.

I agree that 1 - 2 months doesn't make any diff for me as I have waitied so long. I am just curious what is going to happen. Lasttime when dates were current, I made query and got letter its pending. Then when dates were not current i asked is my name check pending. I got letter saying your security checks are pending and visa numbers are not available. that was 2 years ago.

Now this letter doesn't say my name check is pending.

You are also stuck in name check so did you write to senator/ FL? I am sure you must have tried everything to clear name check.

What else can i do ? I am just going to wait for another month or so and call again to find out status.
