Letter from DOL regarding issues on RIR labor certification

I filed my labor certification in Nov 2001 from CA. The state labor got approved in Nov 2002. Last mnth, I got a letter from DOL asking to do one of the following with my LC:
1) Withdraw
2) refile in non-RIR
3) re evaluate - place an ad and interview candidates for the position.

My company placed an ad and its been 2 weeks , no resume came. Should we go ahead and tell DOL the scenario that nobody applied. Or should we wait for some more days and wait for applications and interview people and reject them !! :p

Which will be more favorable to get the labor certified. Kindly suggest.

The letter said we must reply within 60 days , though no date for the ad was mentioned. And it said we need to wait for the ad replies for 12 days. Its well over 12 days now.
 
I guess, you can submit to DOL now. One of friend had same kind query from Atlanta DOL. But they mentioned clearly about recruitment period. His reply has been filed and got approved.
 
very sad to hear itshuman aboiut your situation..
if DOL didnt gave any after proper date you have to reapply then you can do rightaway man
its ridiculas that once you got cleared your labor already one year back..now you got labor query..what's going on man?????
