My 485 was filed last week. PD 12/01. I-140 is approved. Hence RD must be before July31, when EB2 India is current. I hope that will facilitate me getting the EAD, FP and AP in the next month or two. I hope my PD(12/01) will become current in Oct and I will be eligible to approval following that. My H1B valid until Oct07.
1. What happens if I am laid off (say Sept) and then the 485 gets approved in OCT'06 or within 6 months of 485 filing date? Do I have the green card and am free to do whatever I please?
2. I have a valid H1 till oct'07. If I am laid off I will find a new job and transfer H1. I am assuming I should just keep quiet until jan'07 until 6 months have elapsed since filing of 485 and then use AC21 (Assuming employer doesnt withdraw I-140)...Is that right?
3. What happens if there is some RFE that is requested before Jan'07 after I am laid off? Can we just respond to it without indicating I am laid off from original employer or can we disclose it and respond with info from new employer ?
4. If I am laid off, what are the documents that I must have from my current lawyer/employer to make sure I can continue with my case with a new employer/lawyer...
