Legal status while waiting for J1 visa waiver

Hi there,

I have a 6 months J1 visa due to expire on October 2004. I would like to extend my J1 visa for another year and in the same time to apply for a waiver on a "no-objection" basis.

My question is:
Which is my legal status if I cannot extend my current J1 visa for another year but I applied for J1 visa waiver? To be more precise, can I stay legaly in US waiting for the response from DOS/BCIS or do I have to leave US immediately?

no, applying for J-1 waiver does not provide you with any legal status. You should either extend your J-1 status or leave the country.
