legal status of my wife ?

My wife is on F1 VISA.
I filed EB1-OR concurrently while me on H1B.
I-140 approved
SO we have pending AOS.
my wife is finishing her studies in APR 2006.
She plans to go to INDIA in MAY 2006.
She will be using AP for re-entry.
my question is what is her status?
Can she freely enter/reenter without having job or student status.?
any suggestions will be appreciated.!!!

Her status will be AOS.
Since she is a derivative AOS she should be fine re-entering on AP. Did you apply already?

As long as she has valid AP she is fine to reenter.

Whenever you or ur family travel always keep copy of all aproval notices, pending petitions receipts, passport copy and other doc. it always good if some trusted person here in U.S keep one set of all photocopies too.
