The probation would be treated as a conviction by USCIS and it may make him deportable. He should definitely see an attorney (preferably two or three) before applying.

Check out the maximum sentence carried by that charge to see if it is at least 365 days. a theft is often a CIMT and a CIMT for which maximum
senetnce is 1 year can be deportable regardless whether the offneder really receive sentence that long or not
