legal or illegal?plz, help to find out

i need your advice guys on this matter: I sent my application for asylum before my 1 year of staying here timed out( my visa had expired by that time as well).
On the receipt INS sent me back accepting my application 3 days after " 1 year time rule".However, at the interview i was never asked questions about being late or something like that...They gave me recommended approval, but pending it already for 9 months, as if for background check.Well, i am thinking can those "3 days late" be the problem or its something else? :confused:
And 1 more question:Can it be the problem ( with being 3 days behind) for me to get married right now to USC?
please, help to find out,it seems i am loosing my mind trying to understand how it works :o

by the time ur visa expired, u are already considered an illegal resident (I think). but many asylee can still get approved even when they are illegal, but the thing is IF your asylum case get denied, they might deport u to ur home country not like people who still have their visa valid, they can still stay in U.S with whatever status (visa) that they currently have.
 
I don't think those 3 days have anything to do with this delay, the recommended approval letter says very clear that the officer intends to approve your case but you have to wait until the background check is done...so if this delay wasn't an issue during the interview I don't think that is the reason of taking so long.....this happens to many people...call the asylum office where you had you interview....

Ok, but when the case is turned to an Immigration Judge and he or she grants an asylum status, does that mean that the background check has been done before the court hearing? The IJ order means that an asylum status is granted without any pending.
 
Even Immigration Judges wait for the completion of the background checks before issuing 'asylum granted' notices.
