Kudos to the organizers of this board. I can't tell you how much this has helped me.
I hope my problem is rare but someone can give me advice anyway.
I became very suspicious of my lawyer's competence due to several recent events. They included him repeatedly assuring me that he had responded to RFE's when he simply had not. Once might be an honest mistake but twice is a symptom of real problems!
About the same time as these screw-ups, there were other issues. I was so frustrated by all the problems I finally did some of my own research. A couple calls to the BCIS National Service Center and this portal were real eye openers!
I found out that he has mis-advised us and mis handled ALL of our petitions. One major impact is my spouse has been unable to work for the past 1.5 years when he could have had an i-EAD as early as last May! We have been unable to travel due to onerous RFEs and processing delays renewing our visa (he did not submit the proper evidence on initial filing, did not respond to RFE's when he was supposed to and did not even know that we could get the renewal immediately at a port of entry instead of still waiting since Jan for an L-1 renewal!) Not being able to travel has negatively impacted my foreign business.
He also never filed our I-485 with out I-140 (we've lost 10 months due to that screw-up)...
I won't bore your with other details. My list of his screw-ups is extensive and growing as I continue to do my research.
The way I see it, if I can discover what should have been done in our cases with a couple phone calls and 45 mins on the internet, there is no excuse for him not to have known!
His bad counsel has had a significant impact on us financially and emotionally.
To complicate matters further, he is in a different state to the one I live in.
Am I just over reacting or does it seem like this guy is incompetent?
Can I sue him for this damage?
How?
Can I get a lawyer to do this? What type?
I called the bar in his state and was very frustrated by their response. They get so many complaints it takes them months to decide whether it's worth looking into further and then it takes even more months for anything to happen after that. And I'd have to go to that state for any arbritration proceedings. Is this really my best option?
How do I ensure he is not allowed to screw up other poor unsuspecting client's lives?
This is important as I'm sure many of his clients are not even in the US and it would be difficult for them to do anything if he screwed up their petitions. What am ideal situation for him!
