when you got your indian passport years back, you agreed to enter the "indian state department equivalent" and follow their terms. you are out of this system, but only half-way.
no one is forcing you to get the surrender certificate. no one is forcing you to pay USD 250. However, if you want to re-enter this system and get a surrender certificate, you have to follow their rules.
i think a petition or public pressure approach will yield more results than a lawsuit, but how many people in your situation are willing to make this an issue? 90% of the naturalizing indians are going to get indian visa or OCI within a few months of naturalization, and for them not getting an american passport is not even an issue.
