My 2nd term h1b will expired on Jan 31 09. In Oct 2003 (while I was still in my 1st term h1b), I left US for 6 months before I came back. I was told that h1b will be based on how many days do we actually spend in the US, this mean that although my h1b will expired on Jan 31 09 I can extend it for another 6 months because I have left the US for 6 months in 2003-2004. FYI, my company won't pursue GC but will employ me as long as possible. My questions:
how can I get such extension?
is it automatically?
can I apply for the extension by myself? and if so, what is the form needs for such extension?
or is it better get a lawyer, just like when we apply for h1b?
