My aunt has been living in USA on expired I-94 (b1/b2 visa), i think it was expired sometime in May 2007. She is also Canadian Resident.

Now she is planning to return back to canada.

Is there any problem if she takes a direct flight from USA to Canada, Does airline report if there is a passenger with expired I-94? or a land border is a better option?

Thanks for reading/posting

She can fly without any problems, just make sure she turns in that I-94 at the airport counter (at the door) before she boards the plane.

The USA can not MAKE HER stay or anything.

However, her tourist visa is now void and she can not use it anymore, she will have to reapply for one after the ban on her from returning (3 years for overstaying 180 days) is lifted.

Whether she flies, uses a land border, turns in her I-94 or does not, damage has been done. She should not have an issue returning to Canada, but she will have issues if she decides to re-visit the US.
