Leaving US after filing for H1

Hi

Currently I'm on OPT, which ends in June. I will be filing for H1-B visa in April/May. But as the new H1 quota will not begin before October, I have 3-4 months, during which I can't work.

Will it be possible/advisable for me to leave US after OPT end, ask my employer to send me the H1 approval papers and then come back in October, after getting the H1 stamp from India?

Absolutely no problem.
 
absolutely you can go. but there is no garantee that you will get visa...i think you are taking risk

I am in a similar situation as you are. My employer is filing my H-1 to start my job by Octber 1, 2004. As my OPT is expiring by March, I am leaving to India and so will get my H-1B stamped there.
I am thinking of the following complications:
1. How soon will my H-1B approval papers will reach me/employer, in case he files by April 1st week?,
some say I might get papers only after October 1, 2004. If you have checked abt this with your employer. Let me know at the earliest.
