Guys
I have a quick question.
I got my Green card 3 months ago through Company A working as a consultant for company B. Now after 3 months I like to join company B as it is giving me lot of benefits that’s company A has been denying for last 3 years. I am not talking about only monetary benefits but some medical benefits that my family needs. Is there any risk of leaving the company who sponsored your green card before 6 months?

Please reply
Thanks

Check out the contract you signed with company A.

Most of the companies, contract out employees has a written contract when you signed first not to work to client company at-least for one year after you left the company you are contracted through. In my case, I signed a contract that states if I have to work for the client company I have to wait one year after I left my employer company before I join any client company. I do not think this will affect your Green Card but check with your lawyer.

My company is willing to let me go and the other compnay is willing to hire me. My only concern is the INS. Would INS create problem for me down the road that I did not saty with my copmany long enough after getting the GC?How often INS do the auditing and what are the chances that they will question me on this?
Please advise

Ask company A to give you a letter stating they can't afford to give you the benefits you desire and therefore they are waiving you of the 6 month green card requirement and that you are free to find another position. When you apply for citizenship you can present that letter to INS.

there is no as such "6 month green card requirement". Company is happily willing to let me go and Company B is happilly willing to hire me. INS does not have "6 month green card requirement" as far as I know. Any comments?

I haven't heard of any "6 month green card requirements", and I've heard of people leaving right on the next day after they got approved. I wouldn't worry about my citizenship if I were you.

You are right. There is no "6 month green card requirement". Employment based, Permanent Residence implies that you are going to work for your (sponsoring) employer "permanently". But, in the real world almost everyone changes jobs. But the legally acceptable time gap between I-485 approval and one's change of job is not specified (to the best of my knowledge. Please correct me if I am wrong). People assume it's 6 months, probably, based on the AC-21 requirement. But that applies when you are in AOS and not after approval. In short, it's left to the interpretation of INS. I have seen postings that say 6 months to 1 year, is a reasonable time. But again, these are all unofficial opinions. I think it might help to check with your attorney.

??

Anyone else who has changed jobs in less than 6 months after GC approval, or knows friends who did, could you please shed some light on this. Thanks.

My BIL worked for 1 yr for the same reason....

INS may (but that is highly unlikely since they have other hot issues)..create problems if you want to file for citizenship...other than that enjoy your first 10 yrs man...people are dying to get what you have take it easy....

there is no place on citzenship application that required us to disclose when did we leave employer after getting the green card?

You have to give 5 years of employment history. If you apply after 4y9mo, this would include the job change in question.
