My husband go this GC in Feb 2005. But due to differences with this employer who wanted to lower his pay as well as eliminate the health benefits, my husband turned to a different line of employment in Jan 2005 . How can he tackle this question at the time of interview? He has been continuously in residence here since his green card and filing taxes regularly ? Please advise .

Thankyou

He got his GC in Feb 2005 but left the sponsoring employer in Jan 2005 for a totally different line of work?

Was it an employment-based green card? If yes, and the job change did not meet the "same or similar" criteria for AC21, his green card would have been obtained improperly, and it can be revoked by USCIS once they find out about the situation. Naturally, applying for citizenship is probably the most likely scenario where they might find out.

If the job was not "same or similar", the only way to tackle that question is to NOT be at the interview in the first place.

He started his own company -well it was not entirely different line -he started doing his own brokerage in diamonds as opposed to the Diamonds sales manager position based on which he had got his green card .From Jan 2005 up until march 2005 , his employer stopped paying him. He couldnt retaliate since he was so close to his green card. After getting his green card, and no pay forthcoming, he started his own business. So what do you guys think, based upon this scenario ?

That seems like it would be considered similar enough to the original job to qualify for AC21. If he has the tax records and other papers show that it was a genuine business and not just a fabricated position for preserving his green card process, he should be OK (if there are enough similarities with the job duties of the old position and his self-employment position).

He has all his tax papers since 1999 up until last year . But there is no description on his tax forms to show the business he started was of the same nature . But there is enough evidence to show he has been in the field since 1994 until 2004. The nature of job changed only in 2006 , a year after his GC. And also, does his age (47) matter ? WOuld it be likely to influence the officer?
