Leaving after submit the application

Hi,

I submit the N-400 recently. While waiting for FP and IV, need to go to China for a year or so. I do plan to come back every several monthes to keep continous residence. However, after reading post in this forum, I realize there are risks for doing this way. Following are what I am thinking, please provide your opinion and experience.

1. I quit my job half year ago and registerd a software company in county office (address is my home, only one person). In the N-400 application, I state working for my company. When I go back to China for this long period, I will do something relate to my company (develop new software, looking for funding...). Although I am in China, company is registered in US and address is my home. Wil this cause IO thinking I work or intend to live aboard? What should I provide to prove my desire to become US citizen?

2. While in China, I will spend time with my parents. Is it better just say going home to visit family for a long vacation? If so, probably I should come back a little earlier than IV date?

I appreciate your input!

Not good at all.

Despite saying you've ready through the previous discussions on this subject, you still intend to move your residence overseas? Did you perhaps not understand the issue that your application WILL be denied.

If you truly wish to become a citizen, you need to reside in the US. The federal regs (8.CFR) are quite clear on this matter.

Why do you want to screw up at the final stage? You are only creating complications for yourself.

Boatbod,

I do realized there is some risks. But not as what you assume, I am not moving to China. I still 100% want to be US citizen and retire here. There is temporary situation that require my travel which may be 1 year. Many people on this board work aboard(for US company) for a long period of time and still got naturalized, my situation is somewhat different, therefore, I hope can give more detail opinion.

Thanks and regard,
David

There is a significant difference in working for a US corporation on temporary foreign assignment (where you may be eligible for N-470 protection) and working for your own company which a skeptical IO might think only exists as a mechanism for justifying an extended trip abroad. (I'm not saying thats the case, but put yourself in the position of the IO.)

Obviously I don't know all the details of your situation, but if you want any chance of success, you will need to take steps to document and provide proof that your trip is going to be temporary in nature, etc, etc.

Above all else, be aware 8.CFR places the burden of proof on the applicant - you must convince USCIS that you meet natz residency requirements before you will be approved, rather than USCIS having to prove that you don't before they can deny you.
