Leave of absence

My company has recently sent me on Leave of absence and has given me some severence pay.

How long is my H1B status valid?

About 10 days is the guess I will hazard... Beyond 30 days from termination date you risk getting a new h1 (after doing a transfer after 30 days) without I94. After 180 days, you risk disbarment from US for 3-10 years...
 
I am in India for training since 2 months and want go to US after another two months.

Hi Jaxen,

I am in the final stages of my GC....I have an EAD which I have never used and have h1 extension papers which i need to get stamped in india...

I got layed off this mth...and have either the options of going to india for next 6 mths on Leave of absence or work on EAD/H1 with another co...Im thinking of going to india on LOA...My Qs are:

1. How long can i go on LOA during the final stages of GC
(485 RD: 30 Dec 01). I am thinking of 6 mths or so...

2. What kind of papers do i need from my desi company...they r willing to help.

3. If there is any RFE during my LOA what would be reqd from me or my co.

4. What kind of chances am i taking....

Your advise/help would really help me in taking the right decison..

1. Just maintain AP and a mailing address.
2,3 If there is a RFE, the company has to respond. If there is an employment RFE, consult a lawyer to decide strategy.

4. Since I dont know about the amount/quality of documentation you sent for I485, or about the reliability of your company's word, I dont know.
