LCA for H1B at same time as LC for GC?

Hello all,

I am citizen of Canada currently working using a TN visa. My objective is to achieve permanent residency.

My question is this... can I start the H1B process (get my DOL approval then the H1B) and simultaneously get start the labor certification process for my green card? Or do I first need to obtain the H1B before I begin the labor certification process for the green card?

The labor cert process for the green card is pretty long so I was hoping to speed things up a bit by getting my H1B and labor cert for GC at the same time... are there any issues with this approach?

You should be allright. Go ahead apply for H1 and GC at the same time if employer is OK with that.

Also, you don't need H1 to start the GC process.
 
Agreed that I do not need the H1B, however since the TN is really only single purpose (ie. temporary with the intent to go back home) I have heard having the H1B (dual intent visa) help reduce the headache (or potential headache).

Anyone else have any thoughts?

------ You are correct H, L ,O visa have dual intent. Get H1B and file LC if employer agrees and ready to file LC
