Item12 a: Basic Rate of Pay: The prevailing wage for this occupation is $73,195.20 per year. In accordance
with the regulation at 20 CFR 656.40(a)(2)(i), the employer's basic wage offer (exclusive of overtime,
bonueses, benifits, room and boarding, and any other incentives) must within 5% of the prevaling wage
(unless the job is covered by union contract in which case the wage offer must be in accordance with the
rate currently in effort in the contract). If the employer wishes to pursue this application, the wage offer
must be increased accordingly. (If applicable, overtime rate of pay, Item 12b, should be amended as
appropriate.) If the employer dieagrees with the reported prevailing wage, contervailing documentary
evidence must be submitted( a representive sampling accrossing industries; only job and geographic area
are relevant, not nanture or size of a specific employer's busniess): If a published survey, it must be
current, applicable to same/similar jobs in the geographic area, and report an average (not a range) arrived
by adding wages paid to similary empoloyed/qualified workers and dividing the total by the number of workers
("weighted average" not "average employer") and number of employers and employees.


Item 14 & 15 : Contins three categories: Education, Training and Experience. There should not be a requirement
for education, training or experience in Item 15 unliess there is an appropriate , corresponding requirements in
Item 14.

Resitive Requiremnt (revised 10/21/96) : The requirement listed below MUST be deleted or must be adequately
documented as business necessarity in accordance with the regulations at 20 CFR 656.21(b)(2). Recruitment will
not comment on applications which contian certain restrictive requirements even if businees necessity is claimed.
If an employer refuses to remove a requirement identified as restrictive, the case with any busniess necessity
documents will immediately be sent to Reginal Certifying Officer (RCO) to take its place in the queue awaiting
processing.
 
Well, they are right about prevailing wage, no questions there. it is less than what's prescribed for CS in category 1 (around 60 thou.). It's good they're not asking for 80 thou or something ridiculous like that. I think, you should ask your employer to increase the intended salary. IMHO, it will be extremally hard to prove a business claim that 45000 for CS is sufficient.

As for item's 14 & 15, well the course requirements seem unduely restrictive even to me. I mean, why in the world do they require a comuter programmer with curses in Geography? I mean, experince is undertandable, but actual training in Cartography?! Com'on, I've worked in at least three different major spheres as a software engineer, including Developing Applications for Medical Diagnostics. Now, would't it sound strange to require me have something like "basic nursing curses" passed? I mean, the SESA officers might not be utterly bright, but they're definatelly quite reasonable people, you know. I'd think, you should "require" less education/training and more "specialize" the job description. Right now, it seems too generic, I mean, C++/Java is probably 50% of programming world, you could as well write "General Programming duties" :). Put some sleak sounding names, like Oracle Application Monitoring Support, SourceSafe scripting, etc. And be specific with versions, releases and such.

These are IMHO. I'm not an expert of any kind, just a guy like you stuck in LC waiting line for ever :(.

computer grammers,

Level 3 - 46467 (where I am at )..
