Hi,
I joined a new company B recently in california. This company bought another company A in east coast. This company A had labour approval for a specific position. I have taken over this position now and company B is starting my GC process.

My Question is : whether I can use above LC approval and straightaway begin from I-140 :) ....

Lucky U

As long as position, responsibilities, job requirement for position, salary, skills and # of hr's match...one can use the approved labor...

Find a good attorney........Go ahead with I-140/485....Good Luck...

LC transfer

I have the same situation. But in my case , I had LC approved for me in Florida , then the company closed the Florida office and moved me to Texas (same company)

I was told by a couple of lawyers that I cannot use my LC and that I have to do the LC all over again.

Anyone has any ideas on this ??

Thanks
Ash

nk01,

If it is Acquisition-then it is not a problem. If it is Merger, then better ask a lawyer.

chaudhar,

Yes since company is no longer in Florida, you will need to restart LC.
