LC through PERM

I'm planning but no activity (e.g. PWD, Job order) started yet. Still waiting from attorney as he is trying to get some information from state department as lots of things are not clear yet. I am doing advertising and hope PERM will consider advertisement in last 6 months of March 28.
 
which advertising is better

PERM requires 1) two Sunday postings on local newspapers or 2) one Sunday posting plus one professional journal. Please give your comment on which is better? I guess for small/medium towns, choice 1) might be better.

If your position requires expericence, it is better to give one sunday and one journal ad.
 
I guess according to PERM one cannot start advertising until you get PW from concerned SWA first!!

Do I have enough time?

My fifth year H-1B ends on June 1, 2005. I am planning to file PERM LC some where around third week of May 2005 (to enable to file 7th year H1 extension). I have not started any thing yet. Do I have enough time now to finish prefiling requirements? or It is a better option to file a regular LC first and refile in PERM conveniantly latter? DOL also saying that refiling will be slower than normal one.

1. How much time it requires to file a regular LC?
2. Howmuch time DOL takes to send the LC back, if we withdraw the regular LC once it gone to BEC?

I think you will be taking a risk if you decide to file under PERM in May. Your attorney may come up with some issues at the last moment since PERM is still unfolding day by day and no one including DOL has celar picture.

Best option for you is to file regular LC now in some catagory other than the one you want to apply under PERM. Apply for 7th year extension 6 months before you complete 6 years. Apply for new LC under PERM once the picture is clear. Regular LC can be fled in matter of days. You need not worry about how much time DOL will take to withdraw the regular LC.

This is my openion and I am not a lawyer so before you take any action get professional advice.

Would you please explain a little bit more why one Sunday ad and one journal ad is better? In my understanding, a journal will get applicants from all over the nation, while two Sunday ad on local newspaper will only get applicants from local area. If my area is not a metropilitan, I think the latter choice might be better.

Please share your thoughts! My position does require some experience.

I do not think it is local newspaper within the community. It is stated, if I remember correctly, regional paper, such as NY times, Boston Globes, etc. The three additional advertisement may include ethnic or local newspapers.
