Say if a company is applying for a employee using LC substition.
The LC requirements were as follows:
BS or foreign equivalent in CS/CE/EE or Related Occuption.
The employee the company is planning to substite has the following degrees:
BS in CIS (equivalence of 3 year degree + 1 year US College Course work. Evaluation done thru Evaluation Company)
MBA in CIS (US Degree)
1) First of all, will the INS agree that the employee meets the educational qualification as he does not have a direct degrees as required, but possibly a related degree, which the LC stated.(again the confusion of "related" as I am not sure what is related and what is not)
2) A letter from the company at the filing of the I-140 saying how they feel that a CIS/MBA degree is related to the Job Requirements stated on the original labor certification and based on that how the canditate qualifies to do the job. (I am not sure if this letter holds any significance if the INS only considers what is on the Labor Cerftification). Will the INS even consider this letter and give it ANY value.
3) Filing as a EB3, would mean that the canditate requires atleast a bachelors degree. Now can this Bachelors or Masters degree be in any field or has to be specific (strictly specific) to what is stated on the Labor Certificate.
