What is the difference between NON-RIR and RIR? According to what I understand, RIR required teh company to advertise for 6 months and non-RIR, DOL does it.

My question is, do they do it for 6 months? If so, then how are they different processes? In MA, non-rir is Nov 2003 and RIR is Apr 2003. Accorning to my attorney, it will take the same amount in either case.

Does it make sense?

That is in general, not true. RIR usually takes significantly lesser time than non-RIR. As for the MA dates, I believe there is a typo on the update webpage..non-RIR processing appears to actually be currently upto Nov 2002 (not 2003!), while RIR processing dates are Apr 2003.

Even for non-RIR cases, the company will have to advertise (not the DOL), but SESA will give directions for where to advertise, and for how long (usually involved an ad in some newspaper for 3-4 days). For RIR, the company has to show that there have been sustained efforts to recruit for that position, but with no success, hence the recruitment effort needs to be done prior to filing for the labor cert., and for a longer time.
