LC approval notice lost in mail

My LC approval notice sent by Chicago DOL was lost in the mail. My lawyer talked to DOL and it looks like a duplicate copy will not be issued. My lawyer is filing for my I-140 without the LC approval notice and it seems the procedure is that BCIS would request a copy of the LC approval from Chicago DOL. Has anyone had a similar experience ? Please let me know. What exactly needs to be specified when I-140 is being filed without a LC approval notice ?

---- Your lawyer knows better what he/she is going to write in the cover letter to BCIS. Lawyer may write the case # that he/she received from SESA or DOL, Lawyer may file the copy of LC that was filed for you ETA750 A and ETA750B and DOL will reply back to BCIS that it was approved.
 
Yes, I've handled this situation about a dozen times (I inherited the cases from another attorney and that attorney had lost the originals but we had copies). In your situation I would explain what happened explicitly in a letter when I submitted the I-140 to BCIS. You probably can't file concurrently. Be prepared for lots of problems and long delays (expect your I-140 to take at least 6 months more than normal). Also be certain to ask BCIS to obtain a duplicate from DOL and it may not be a bad idea to cite the rule that prohibits DOL from sending you a duplicate but that they will send it to BCIS. The rule is pretty specific.
