My employer is about to file my LC. In the process I have discovered that during my student days, I worked for 3 months without proper authorization with my current employer. During this period my curricular practical training permit had expired and my optional practical training did not kick in till 3 months later. Neither the employer nor I realized that this had happened. Later during the latter half of my OPT I joined the same employer as a full time employee and later converted to a H1. I have mainitained status through out.
My question is this, do I report the discrepency to my attorney (he is being paid by my company) and my employer ( HR representative). How significant is this error and how will it affect my chances of the LC being processed. The attorney in preparing the LC has included this experience as a part of my work experience. What are the chances of somethng like this being ignored? If discovered what are the penalties if any? The LC is being filed on tuesday this week, please share your wisdom on this matter. Thank you.
