Layoffs and Labor Certification

I filed for my GC labor in October 2002 under RIR for a Software Engineer position. It was forwarded to the regional DOL in May 2003. My company got aquired by another(much bigger) company in August 2003. As part of the acquisition, they layed off around 10% of the employees( we had around 120 or so). But everything is fine now and we have hired more people than the ones that were layed off. My case is still stuck and must now be in Dallas BEC. What are my chances of getting an NOF from the DOL?Is it almost guaranteed due to the previous layoff's in the company? What are the chances of my case being rejected as RIR and sent back into the non-RIR stream? Thanks for your answers.
 
Layoff can create problem during LC process. But, in your case, company hired more people then they originally fired.

In case DOL/SESA issues RFE/NOF, attorney needs to explain the reasoning (like company restructuring etc.).
