LAYOFF AFTER 180 DAYS OF 485... PLz HELP

Hi Gurus

WHat are my options as per my status is concerned.
My 485 was filed 8 months ago

RD: 10/9/2001
ND: 11/13/2001
FP: 03/19/2002

EAD recieved

I am looking for a job. Can the employer mess with my I485? Also how long I can stay without a job? What can be the worst case scenario for me?

Also anyone with WAC-02-035-XXXX approvals at California center..

Your employer can't mess up with your process. But they can disallow the company lawyer to release your file. In this case, you need to hire your own lawyer and they have to transfer your file to the new lawyer.

You can stay unemployed as long as you can. I there are no Employment RFE or interview, then you will be fine. Otherwise, you need to have a job when either case happens.
 
Worst case scenario: They may send RFE to verify your employment, lawyer from your company will send information that you are fired or he may just do not respond on RFE. In both cases your application will be denied.

You can be without job as long as your I485 is pending, because you are in AOS status.

Thanks for your prompt replies.. but if they send an RFE for employment and I get a new job within the same field. The new employer replies about my employment. Will that work to clear the RFE or do I have to file a new I140 and I485 from the new employer.

No need to fear

You do not need to file new I140 or I485

Just get the new job, reply with the Emp. letter from that new job if and when RFE comes -- and you are through

There are plenty of cases such as your which were approved recently.

Hey

Don't worry about your status. Just concentrate to get a new job asap.

1. INS can approve case with out asking any document
2. If INS issues RFE.. U need to reply with new employer offer and change of employer notice.

I changed my employer and working at new employer. I am waiting for my status. All my buddies got approved their GC after changed employer.

Personally i recommend to concentrate on new job.
 
do't worry about it , get a new job with similar profile and salary. There was case when even employer had revoked I-140 after 6 month of filing 485. INS first denied the 485 then approved it. This case details were present on murthy.com. So as long os you have a job ins similar profile and 180 have passd you are okie.
