Lay Off Situation, please HELP

Please Suggest, My project ended, and for last 2
months i am without Salary ??

Now i\'m getting a Job (Contract to hire) and the company
wants me to work on W2. Will that be problem if INS
ask me for the Employment Letter ??

And the Hiring company says, that they can issue an Employment
letter, but they will even mention that i\'m working on
CONTRACT !!!

Can this be a Problem if RFE for Employment is issued

Please help, any response will be greatly appreciated !!
