Hi All:

I have been asked to sign the Termination letter,
otherwise My H1 will be canceled.

My 485 is in Process Rd:07/01 Nd: 09/01 @ NSC

I have valid EAD and AP documents, what options do
I have ? I was still on H1 with my company, i never
changed my status to EAD..

Can he cancel the H1 and will it affect my GC Process ??

You can use your EAD to find another similar job (AC21 180 days)

You don\'t have to worry about H1 any more.

anywhere, no geographic constraint ??

And do i need anything from my leaving employer ??

Once you file 485 you never loose status untill INS makes a decision. (as long as you were "IN

at the time of filing 485). You can apply for a EAD and work on it.
You will be OK even if your employer withdrwas I-140 because you have
crossed 180 days.If you dont get a RFE you dont have to do anything
your GC will happen pretty soon as your RD is in 07/2001

Don\'t Need H1

Once 485 is filed, I dont think you need H1, You can use your EAD to find some other company in similar position and once your 180 is over (RD of 485)then you are safe.

H1 comes in the picture only if something goes wrong with your GC Processing, So many people process their second H1 where they Join in Similar Category.

I\'ll suggest, you should talk to some good lawyer .You can TALK to JIM M also he\'s very active in this forum.
 
One last thing to note...very important

at the time of approval, you should have a valid job...because your GC is based on employment....otherwise u are currently just fine...just get a job in the same field as mentioned in your labour ASAP
 
I agree with the posters here

You are in adjusting status. Just be certain that you do not leave the country without AP, you can use EAD to work for any employer (full or part time) but you need a permanent, full time position that is similar to the one descibed in your LC before your GC is approved or when INS issues an RFE or schedules an interview.

My Case was filed by my company\'s Attorney, is there
anything i should be worried about ??

And is it Safe to change the Attorneys at this stage,
coz all the PaperWork from Labor to Filing of 485 is
with this Attorney, can INS request for any info from
those stages.

You will not need a new Lawyer if you dont get a RFE(best case scenario)

But if in case of an RFE for I-485 you will probably need one and if you dont trust your current Attorney you can change to a new attorney.
I think all that is needed is to file a new G-28 along with the RFE and a letter from your new Attorney. But first and foremost you need to find a similar job.
Since your current company has terminated you, you dont need anything from them that is if you can find a new employer, otherwise you need to suck-up to your current company to hold you on since you are extreemly near.

Everything depends on the RFE if at all one is issued.
