My company is contemplating a lay-off the end of next month. We have 350employees here and the company will probably lay off 100 of us.
I should not be laid off as my understanding.
But I am going to file I140 soon.
I am afraid the lay-off will affect my I140.
What additional material I need prepare to make sure my I140 has a better chance to be approved without RFE?

Welcome on Board

Hi dududidi:

I am pretty much in the same situation. My company went thru a massive laid of on July 2002 and I concurrently apply for I-131, I-765, I-140 & I-485 on January 2003. So far everything is going well and I-131 & I-765 have been already approved for my wife and me.

Nothing special was done by my lawyer.

I hope this gives you some peace of mind.:)

My company had about 100 people in 2001 peak time. By the time my I-140 was filed in 2002, it had only 5 people. My I-140 has been approved recently. Hope this makes you feel better.

you dont need any additional document. you can file i140 without any problem and the layoff will not affect you in anyway as your labor is already approved. layoff may affect future labor petition from your company.

note that labor stage is to check whether the job offer is genuine and the salary is equal or above prevailing wage and there is no us citizen or permanent residents to take that job. i140 is to check your credential by how you fit that particular offer. so dont worry.

has a better chance to be approved without RFE?
