Lawyers' opinions about returning to COP with GC

As you know a thread like this was created by Jubilee, but he/she deleted. Why? only he/she knows, no problem Jubilee.

I would like to share what my lawyer said about returning to COP with GC:

Basically he said that it is a difficult situation. And it is better to wait until get citizenship to avoid any issues. But, maybe the issue will never come up.

Could anybody else share in here what your lawyers say? If you do not know yet, could you please ask them and share? PLEASE. Thanks.

Hello everyone.

I had asked my Attorney regarding to return to COP with Asylee GC; she told me never go back when your are PR unless you became USC.
She said some people go to COP when their return in US at the Port- Entry they can have a problem with IO or in the Citizenship interview they will be in trouble.

My wife's aunt family got their citizenship interview recently (theis status is Asylee). They have been asked if they ever visited COP after getting GC's. So this kind of question can be raised during the interview.
 
I've been to other asylee forums where people have seen their friends getting their greencards taken away for visiting their country of origin, after getting their greencard through asylum. Even if you make it back ok, they will ask you during the citizenship interview and they will know if you are lying. Remember that every flight into the U.S must submit a manifest with all the passenger's names and citizenships. I think it's a silly way to give up something that was so hard to attain. Why can't you wait 4 years and become a citizen before going back? Personally, even after I become a citizen, I have no plans to go back.
 
My lawyer says its ok to go back to COP for temporary purposes and make sure you have good excuse of going back..
 
what about my wife? she came here through aslym but applied and gotten her GC thru marriage with me(us citizen) will she run into any trouble cuz she's planning to visit her COP for two weeks.

simple. look at her green card. look at where it says category. if it says AS6 or AS7 or any other AS it's an asylum green card. If it says IR5 or any other IR it means immediate relative. I'm sure she can travel freely with the IR greencard. If asked how she got it all she has to says she's married to a u.s citizen.

her category is CR6 i believe.
 
My lawyer said you can visit your COP after GC. I don't plan to, but since we are posting what our lawyers have said, that was my lawyer's comment. And his expertise is asylum-related cases from start through to the citizenship level, so he does have experience with the issue. BUT like I said a million times , it is a personal choice and people should consider the level of their worries and what feels best for them and for their situation. Plus perhaps his answer pertained to my situation and my asylum case which he knows very well about and it was not political related so perhaps his comment might have changed if my asylum case and my situation were different. So take it with a grain of salt.
 
I have asked two lawyers about it, one said it is ok, the other one said..DO NOT GO...

two lawers..MR. Allen Kaufman and Ashwini Bhakri in san francisco said..it's ok to visit your cop after GC.
 
This seems to be an endless conversation. If somebody is looking for an answer then there is none. You can go or you can choose to stay and wait. If you'll go there is a little chance of getting in trouble, I would say 2 out of 100. And we all know damn well that a lot of asylees go to COP even before their GC, I know few personally. So what's the point of discussing it?

Ayyubov: We are not discissing about returning to COP, this is a thread to put together lawyers' opinions on this issue. That is all my friend. Thanks for understanding.

There is no written law that says its ok to go to COP. When lawyers say its ok to go back to COP, they do not reference any immigration law in the books. They say "yah its ok"...If you get in trouble, are you going to tell USCIS that my lawyer said so thats why?

If you ask a lawyer, ask him what law number references that so you can print it out for yourself in case.

Cl_Asylee, nobody is saying that you or somebody else are going to go back to COP. It is personal decision. But I have only one question. According to your words you are not going to go back to COP. Why then is it so important to you and other forum members lawyers opinions about this subject?

WanmyGCnow is right about the whole opinion thing. A lot of lawyers don't have a clue when they give their opinion like that. Some of them are saying it is ok some are saying it is ot. That means that 50% of lawyers are full of crap.
