Lawyer Issue

I had advance parole approved last month. I was waiting for it to arrive at my residence. I asked my lawyer if he has received it. He denied. Yesterday, he called and told me that some other lawyer in his organization has received my papers a month ago ( as my name is common Indian Name, too many people have same name) and he received today from the other lawyer.

Can this kind of situation cause any serious problem for me.e.g. In case of RFE ? I instructed him to receive my papers directly.

When RFE is issued, does status gets updated on Online Status check.

Please advice.

yes it does get updated that rfe has been send. Tell our lawyer to verfy the lawyer info with INS . Though INS is capable of doing what you told , you can bank on that .:eek:
 
Sounds like BS to me that the approval notice went to some other lawyer. Did your lawyers change since you filed the approval? I know in my case, while the firm has remained the same, the lawyers have changed around a bit.

But this kind of delay of 5 months is ridiculous! Specially in case of RFE etc. I don't think there is anything to be done as far as INS is concerned, but something must be done at your lawyer's office.

Chew his ear off for this, tell him how disapointed you are about this gaffe, and tell him if it happens again you will change lawyers. And you have a pretty valid reason too.

this is a classical example of "negligence". If they were aware of the fact that Indians have common/similar names, they should have been more careful about the mix ups.

Your guess is right. It is an organization of lawyers with one big lawyer as boss. Today I checked with them and I found out that my original lawyer resigned from the company and they assigned my case to another lawyer without bothering to inform me.

I have given them strict warning about these kinds of things happening in future. I even have written communication via email for this incident.

The moral of the story is "BCIS is negligent. Sometimes our lawyers are negligent too"

Let hope everything goes smooth in future.
