Time to dance and celebrate. This is Rajiv's Christmas / New Year gift to us. Let us fight this dirty USCIS . One week back, Rajiv told the core team about filing this law suit before Christmas. Ever since we lost our sleep. We kept this close to our chest because it's better to talk after the action.
Let's spare all our time and energies towards making our(immigrationportal members) Lawsuit a great success.

More details

Rajiv has filed the Lawsuit on behalf of us (members of immigrationportal.com) . We told him that we will collect a fund and pay him some Fees. But he declined to take any Fees from us. He is doing this as a service and commitment to us. It costs a lot of money for him because of the amount of time he and his team has to spend on this case. Hats of to Rajiv. Let us fully participate in the Lawsuit activities by reviewing the complaint that Rajiv has posted and offering suggestions. Rajiv can always submit modifications to the court.

I really appriciate what Rajiv and others are doing.
Even though my case is approved I still thinks USCIS sucks
and they shoud improve their customer service by reducing the huge backlog.
 
Duty

Our duty is to follow up, all: Core team, all members, active inactive, believers or not,

THIS IS WHAT RAJIV SUGGESTED: Some of these ideas were on the table from the beginning but people were bitching instead.
At least now, do it for Rajiv and the community at large.

We should again start a fresh push to Congressmen,
Khatri and other CIS officials. Once the law suit is
filed (which we have already done), we can send a copy of complaint to our
congressmen. Also we should approach all the sponsors
of Infrastructure Improvement act, so that they might
bring back those issues again in Congress and also
they might question the appropriate CIS officials.


Publicity: Let's try to reach all ethnic
organizations(Indian, Chinese, Russian, Latinos,
......), organizations like IEEE, Big
corporations,.......... Let's gather the support of
everyone for our cause. Have them issue statements in our support, call their Congressmen....

Core team has no role in filing of this law suit. 100% credit goes to Rajiv. He did everything and just informed us when he is all done. The core team is only acting as a bridge between Rajiv and all the members in this forum.
Actually core team has been pretty inactive now a days as everybody has become pretty busy. Only a handful of people are hanging around and we aren't doing much because of the holiday season and also due to our excitement with the Lawsuit news. Every one who wants to contribute to the lawsuit , can be treated as a core member.

Once again, let us thank Rajiv for his selfless act of Service.

THANKS TO RAJIV FOR ALL HE DID. Apparently he picked our ideas also, from long ago, the petition times. Congratulations to the ORIGINAL TEAM for never giving up. Edison, kashmir, Yjay, dsatish (the new) and others. For US there is no HOLIDAY. Now is the time to follow up, whether core team or NOT. Go back to the threads and find the organisations, the companies, the religious leaders, the lobbies, the Ethnic campaign, the Media and JUST DO IT. This is our duty to Rajiv and the immigrant community.

Examine also the DHS Act (newer) and mention it also. The fight is just beginning guys. NOw is the time to do what most of us missed in the past.
 
I read the actual petition and had a few comments:
1) Whether we debated proactively addressing the issue of need for security checks and a practical way of accomplishing without delays. I mean this could be obvious defence of INS and whether it makes sense for us to say this could be accomplished without so much delay !!
2) Whether we can debate some suggestions /remedies to clear the backlog so that we could provide that as ammunition to say why did you guys not do this. This is partly included in the petition in form of EAD AP and fingerpring renewal requirement but anything else. We might be slightly handicapped by lack of complete knowledge of the actual process followed but to the best we can.
 
Is this the first lawsuit of this kind? I think Aguirre, when speaking in Canada a few weeks ago, referred to some court challenges. Does anyone know anything about it?
 
I guess this is the first class action lawsuit by I485 applicants. Aguire was talking about over all immigration issues. They faced hundreds of individual and a few class action law suits. I think that they (BCIS) haven't won a single case :p .

You are right that we have to debate many issues in the lawsuit petition so that Rajiv can make changes to it. Please start debating in that thread or the thread created by me earlier to debate on lawsuit. I will bring that thread back here.
 
Whatever the outcome of this case, it's uneasy for many of us
not to contribute anything towards this cause and try to sit back and expect something from Mr. Khanna and his associates and many of this forum memebrs efforts.

Please ask them to provide a mailing address. We voluntarily make contributions towards the fund. It's upto Mr. Khanna, whatever way he want use this fund. Atleast we can help in the way we can.

I think, Mr. Rajiv need to add 'National Service Center' since they also have started processing transferred EB I-485 cases as well as local application center (where huge dely after getting EB I-485 cases transferred) like NY, Chicago-IL and ATLANTA-GA in the defendant list.
