My fiance and i are trying to get everything started for her green card. She was caught once at the border with her parents at the age of 14 she is now 21. Do they keep minors records when they are caught at the border? If so i think that would affect us on applying for her green card through our marriage. Any help would be appreciated thanks in advance.

yes they keep records, your going to have to not digress anything when it comes to unlawful entry.

Hi Espedito,
she entered and remained illegally, so she does not qualify for any benefit at this time. She (and you) needs to wait for a immigration reform or I-245 act. You should consult with a immigration lawyer before applying for any benefit.
Good Luck.

no her family crossed illegally.

Is this correct ... after that incident when she and her family were caught, she was able to reenter the US another day? After re-entering, how long did she stay in the US illegally before leaving, and at what age did she leave? Or is she still inside the US?

no her family crossed illegally.

What year did she enter the US illegally? Do you know if her family ever filed for any immigration petition? It is possible CBP created a record for the initial arrest with her parents, which is a standard protocol for CBP to do. In the absence of 245(i), I see no relief for her immigration process in the US.

She can leave voluntarily, serve her ban, and reenter properly. You can marry and live in her country until she can legally return to the US. If you truly love her, you should be willing to do this.
