I am wondering if anyone has some insight on what might happen in my case. I am a citizen and my wife had her conditional residency expire in January 2009. We didn't know it was a conditional residency and didn't realize it was expired when she left the country to visit her family in March (I KNOW, BIG MISTAKE!!!) so now she is stuck outside the country and we were advised by a lawyer to submit an I-751 which we did on April 3rd, 2009 to the CSC.
On April 14th 2009 we got a "Termination of Conditional Residency Status" letter (dated April 8th) saying they had not received the I-751 since it had expired in January. I have since submitted proof that they received the form on April 3rd (USPS Delivery Confirmation) and requested that the determination to terminate my wife's residency be removed.
On April 16th we got the I-751 kicked back because it did not include an explanation of why it was late. We have since also submitted that form (again).
So my question to this forum is - do you think they will approve the I-751? Its been almost two months since I've seen my wife and I'm desperate .....
