Last year on H1 and perm

Hi all,
I am in my last year of h1b visa. I have 10 months remaining on my visa. I have a another job offer. If i join them they have promised me to file for green card with in a month. But as per the perm process it will take 60 days to file for labour. As per my lawyer if I file for I-140 I can get extension for 7 year. Does anybody have idea if its really possible. My understanding was i can get extension only if i have filed before my last year starts and its not related to 140 approval.
Has anybody any idea about this. Is it possible?

Actually it is related to I-140 being approved. I recall that as soon as I-140 is approved you can file the extension - if you are retrogressed you can file for 3 years at a time.

agholap, I don't want bust your bubble but i think it all depends on how your case if filed. My case if filed in chicago under PERM/EB3 on 06/13 and it is still in process. Even for PERM your employer needs to show a consistant recruitment process to hire an us citizen for 3 months. So, don't how they can file immediately.

Does anyone know if it is possible to file for PERM in the 6th year of h1 status. I have apllied for labor certification and my case is at the dallas BEC. I am not sure if I can get an approval before my spouse's 6th year starts. Can sHe apply in the 6th year and still get the 7th year extension. We are in a big fix. All the gurus, please, any opinion is valued.
 
How do you prove that your LC applied was 365 before the expiry of your 6th year ?
