last name spelt wrong in I797 form & other related forms

Hi,

Employer applied for Premium H1B transfer processing and INS approved the petition recently. But Lawyers spelt my last name wrongly and so INS did the same in I797 & other related forms.

What next step to correct the name in these forms?
How long does this process take?
Current visa stamping in Passport expired in Jan 2004. Latest by what date should I get new visa stamping done(Given that name is spelt wrongly and name correction process may take some time)? I may plan to go to India in Nov 2004.
Can I leave USA and go to India for vacation and enter back into USA(given that my name is spelt wrongly in I797 & etc.)?
Can I go to visa stamping using the I797 form where my name is spelt wrongly?

--- it is not USCIS mistake let your lawyer get it corrected and he will be able to anser your questions ,concerns
