Last Nail ! - What is happening @ VSC

Some more information....

The RD for my 1-485 was 12/21/04, I did go through the same steps as being outside 60 day period and no notifications since the past 30 days. I called VSC few months back, spoke to service agent, got a "long" confirmation number, was told to call back after 30 days if no notice was received. 30 days past and I still did not get any kind notification on the status, no suprise there. Called them back, gave me a new confirmation number and was told to call back 30 days later with the same mundane note to call back.

At the same time I had approached my lawyer to find out on what is going on with my case, the reply she got was that I'm currently under security/background check and that VSC is 6 months behind on it. Any news will be after six months. My last RFE/LUD was 12/20/05, since then there were several LUD changes, but no approval as yet.

Few weeks back I got a letter from VSC, stating that I'm currently fallen into the backlog for non availability of visa numbers and that I would have to wait until I become current with respect to retrogression dates. This most likely in my interpretation means I'm past the security check and most likely sitting on the application pending visa number allocation.

So folks I hope many of you who had posted here could relate to that. Appreciate if someone else has any more information to post it here.

Rejected with reason: Priority date is not current
I485 Refiled: 05/01/2006
Rejected with Reason: PRiority date is not current (05/18/06)

1. Why I485 is rejected twice even though priority date is current?
2. What does immigration offier look for to find out PD is current?
3. What should I do next?

Wild guess: Could be due to "amendment to name"?
Solution: Talk to a lawyer, if you have'nt already done that yet.
Another solution (worst case scenario): Wait for I-140 approval. It should be arround the corner for you. The I-140 approval notice will have your PD date. Apply 485 with approved 140.

Disclaimer: My opinions in the matter of immigration are worthless.

Thanks for responding. I discussed with Lawyer and she says she need to go through legal body to discuss with Immigration officer. Is it the right approch?

I called VSC (after waiting in Queue for 45 minutes) and spoke to a lady she took my details as usual and told me that I should receive a explaination letter with 30 days. I asked her if she needs my 'Reference number' from old enquiry she said it is for applicants use not for them. they don't need to know it. After the call I asked her if she is giving me the new 'reference number' she said "I didn't do anything special for you so I can not give you the reference number".

What I got from this that if you get the reference number means they are trying to push your case. ( Just a guess)

Now I received a letter from my old inquiry (last months inquiry) with the information like "Your case is under review right now. You will receive a decision or further notice for action within 60 days".

Not sure what does it mean!!! has anybody ever received this kind of letice (from inquiry)? or know what does it mean!! please reply to this or send me a PM.

Thanks a lot GC_Charm for the information you kindly supplied here!

I think if they sent you official letter indicating that your case is under review, then that is it. I can not see any reason that they officially sent you a lie. Just wait and see.

Yes that is what they are saying for just making us wait forever; NAMECHECK OR SECURITY CHECK OR SIMPLY CHECK BACK :-( I don't when the end of tunnel is atleast going to be stated

Its weard that VSC is trying to delay the cases for no reason!! Do you think I should contact senetor for this? Would this help?

Actually after reading few threads on the Senator contacts it has not been so successfull but you can give it a shot.

I am not able to think of any as people have run out of ideas.

Still waiting

The VSC seems to have just put our cases in a pile somewhere and forgotten about it.My PD became current May 1st(EB1 OR I140/I 485 Concurrent RD 3/17/05 I 140 AD 9/05,FP (code 3) 8/30/05 LUD 9/17/05,4/22/06,5/1/06).Initiated a enquiry 5/10/06 ,given the long confirmation number-no response yet.Initiated a senatorial enquiry recently-don`t know if anything will help.
Just hope this gets over soon.The wait is killing

Looking at the emails [ letter - SENT by VSC ] posted in this forum i guess it is turning really frustrating - What does it mean by no time for such processing ?

Has any one got this too ???

USCIS processing of retrogressed cases

After having really surfed the net for anything that is available regarding the AOS,I have concluded that:
1)The USCIS just stops all processing of AOS cases as soon as the PD gets retrogressed,they are just put in a pile somewhere.These are the " visa hold cases"
2)They conduct "sweeps" of all these cases and when they find a cse whose date is becoming current,they pick it up to the processing file-thus the LUD we see just prior/around the PD becoming current.
3) On the day the PD becomes current they request a name check/security clearance-this is the "security hold"
4) After the name check clearance is recd(which can take as long as the FBI/CIA or whoever is involved wants-for they are not answerable to us ALIENS :( ) ,the case is ready for "final processing/further review"
5) After this the Service center assigns it to an adjucation officer-VSC (since it is handling all the H1B cases this year) is understaffed and probably the assignment is happening at a snails pace.I am not sure if it is by the RD of the 485.
6)Whenever the adjucation officer "devta" smiles on us poor aliens-the magic e mails start
7) NOn retrogressed cases/ cases whose I-140 were recently approved probably do not make it to this process-as they are worked upon actively by the officer they were assigned to-unlike our ORPHAN cases :( ,so they are being approved really fast.

Based on the above I honestly don`t think any amount of Inquires/Senator/Congressman/FOIPA requests will do anything to speed it up.Probably the only thing that will help is patience and prayer(the GC makes even non believers like me into devout people).
So Good luck to everyone-hang in there-be patient and one fine day the GC God will smile on us too.Till then lets get on with our life-there is so much else to do and not doing it won`t make it any faster.
 
You are probably right. My priority became current on May 1, 2006. I saw an I-485 LUD on April 27 2006. Now I am just waiting and waiting ... driving me nuts! I don't know what VSC is doing with my case!

I have a friend whose I-485 got approved on June 6 from California Service center 6 days after his date became current.

First LUD on April 29 ,2005 Finger print code: 2 - Visa is Available
LUD on May 15,2005 finger print receievd by INS
LUD on May 26,2005 -no message change
LUD on May 30,2005 -no message change (but I received RFE on June 03,2005)

RFE is for : Birth Certificate, EVL , Pay Stub ( Sent on 06/20/2005)
LUD on June 30,2005 - INS received the Reply for RFE -

July 01, 2005 - Visa number no longer available..

I call for Inquiry on August 25,2005 - INS sent letter on October 15, 2005 for the inquiry. They said Visa not available - we need to wait for availabitlity before again to touch my or continue process of I-485. no LUD.

LUD on March 3, 2006 - (When Visa again available) I called them and asked if my papers will be touch, I spoke to the officer and said wait for 30-60 days but no changes and no reply. The officer said that she cant gave me no other info besides what ever i have on the message on the web.

I called for Inquiry last May 08,2006 and they gave me Confirmation number or reffernce number and said wait for 30 days for there reply. No LUD changed
 
Ok I guess folks with the latest July 2006 Bulletin it is just turning to be a pain; More misery to hold for another month and see what Aug 2006 might bring;

I guess running out of patience is what they are testing out. And see how many will break and succumb to this pressure.

July Visa bulletin:bad news for India

Yeah the July visa bulletin is bad-and with the name cheacks taking so long-just hope it gets over soon-it is getting unbearable now :(
 
I think July visa bulletin is actually good for people whose PD have been current for quite a while and yet their cases have'nt been approved. For example for EB3-India PD has moved from April 08 to April 15th 2001 - it's good in the sense that VSC won't be approving any more of new EB3 cases with PD of April 2001 or greater. In the past month I have noticed a whole lot of EB3 approvals with PD March 2001 even though there have been a whole lot many of us with PDs between Jun - Dec 2000 who are still waiting anxiously for approvals - So I am hoping that VSC is going to start taking care of these cases first and go as per First In First Out method..
 
Aakash28 I hope what you are stating is true. But you look at the fact that every day thousands of EB3 cases are picked up by VSC and LUD changes but only 1 or 2 approvals that is thing that is worrysome as you can see that lives the hopes of few lucky ones not the first in first out.

I am going with this theory; might make sense for sometime i think.

VSC is working on cases which are staright simple but if they get an complex case then they are either reverting back with a RFE or going to stack in again.

But then what about all the EB3 cases with PD between Jun - Dec 2000 - I have'nt seen any approvals for such cases - they all can't be complex at the same time?
 
They are stuck on one of these in those case

Securiy check / Name Check / FBI Check

So ultimately it does not make a difference until an LUD states it is approved.

Because as such there is no pattern for approval.
