My H1B (visa stamp and status) expires on Feb 1, 2004.
I am planning to visit my country and come back to United States by Jan 25.
My employer is going to apply for H1B extension after I return.
------ Why you delay the filing of H1 extension? Your employer can file H1 extension for you NOW, because if you file H1 extension NOW then you may get the H1 extension filing receipt before departure and if you are out of US then your H1 extension filing is NOT abandoned. You can go out and enter US with Valid visa stamp on Jan 25, you will get I-94 at POE till your H1 visa stamp on passport, once you are back your H1 extension will be approved in 2-3 months and it will have newI-94 attached with H1 extension approval and that will be your new I-94 , no problem.
I would appreciate if any one can share her/his experience with re-entering USA just before the expiry of visa. How safe is it? My port of entry will be Washington, D.C.
