Landing and Medical Surveillance and US Return

--------------------------------------------------------------------------------

Folks,

Can someone shed light on the following problem?

Want to land with wife soon and return to US to work before moving to
Canada permanently in January 2006. Landing expires August 2005.

Wife's landing has Medical Surveillance conditions attached. Inactive TB.
She has to report to medical authorities within 30 days.

My question is:

1. What exactly happens for medical surveillance cases?
Is there any chance they might deny landing if I say
we plan to return in 2 weeks?

2. Are we free to return to US in a couple of weeks, say? Is there any
chance, Canadian authorities might compel her to stay and complete
the medical formalities, whatever time it takes, even 3 months or more?
i.e. Compel with the threat of losing her PR or landed status?

Any help is greatly appreciated.

No idea. If I were you, I would land before the visa expires. You can re-enter Canada by road to report to medical authorities. Since Jan 2006 is not too far away, your wife can stay there for 1 month and finish the formalities. Thats the best thing to do. I am not sure if they will reject after 30 days, if they did its easier to appeal from within Canada. Consult a lawyer.

I am in the same situation as your wife is. I just wanted to share what I know so far. I landed early this month and reported to the public health department in Toronto. Since I need to go back to US next week I asked for their advice after reporting to them. They told me I completed the first step required by CIC. I am supposed to see a family doctor within 90 days if I stay in Canada. However, if I cannot complete the whole process, I will have to start over the reporting process next time when I permanently land in Canada. As per what they say, it shouldn't be a problem. Just report to them again next time when you land.
Hope this helps!
