I have recieved a RFE and my question is:
If IN$ wants me to submit 6 months pay stub how can i do it.
1.)I was working from AUG-97 to december 2001 (GOT All Pay Stubs).
2.)went to school between december 2001 and April 2002.(5 months no pay stub).
3.)Currently working for the past 1 month same employer.
Please advise, any advise would be greatly appreciated.

Please clarify

your status when you were in school.
1.Were you FT - in that event, you would have your I-20 or F1 and should be able to submit that with your paystubs.
2. If you were not on I-20 or F1, I do not know what your status would have been and how could you explain that.

For anyone to advise on this, it is important to understand your status in those 5 months at school.
 
Status was H-1B , school was part time.

Status was H-1 , school was part time,
We(On H1) are allowed to attend school part time.

Status is not a problem I have always been on H1
only worry is when IN$ Asks for 6 Months pay stub ??
 
Did you work when you went to school!

Did you get paid when you went to school. Technically if you did not get paid then you are out of status in H1.

With awaitGC; The H1 is a Employment Based Visa and you must have an Employer sponsoring your status; for this you must be in Employment and drawing the agreed salary.
Eventhough you are allowed to go to school, your primary status is governed by your employment; If you had applied for a COS to Student Status then I think you would have been safe.
this is Just my understanding of the Case. Consult with your Attorney for guidance.
