Laid off - TN Grace period

I just got laid off from my current employer and my TN is valid till Feb 2025 and our family TDs also have the same validity. How many days I can stay in the US without losing status, i heard it is 60 days and its applicable for myself and dependents (TDs) as well.

Any inputs will be appreciated.

You remain in TN status until 60 days after you leave your job, or until your I-94 expires, whichever is sooner. Your dependents remain in TD status as long as you remain in TN status, or until their I-94 expires, whichever is sooner. So basically, if you do not extend or change status, then both your TN status and your dependents' TD status will end 60 days after you leave your job.

Thanks newacct! One more question

I started discussion with our previous employer who may offer me a job in the next couple of weeks.

During this 60 days grace period, can my kid (Canadian with TD status) attend elementary school? as TDs are allowed to attend school. I cannot work as I am on TN, wondering if TD kids can attend school during the 60 days grace period.

Also, when I get a new TN letter from my future employer, can I just travel to border and get new TN I94 for me and then apply TDs within US by sending application to USCIS? that way, my family will stay in the US and I will just travel out and get a new TN I94.

Yes, the kids should be able to attend school during the grace period.

I believe that, once you get your new TN admission, your TD dependents might be able to continue to stay without needing to extend status. Others can chime in on that.

The TDs are tied to your status, not your particular sponsor. So they do not need new TDs until their I-94s are about to expire.

Thanks nelsona! Atleast kids school is taken care for the grace period of 60 days.

I will focus on getting a new job and TN, I myself will go and get new I94 at the border, then, will extend the existing TD I94s (they are valid till Feb 2025), within US that way they stay within the US.
