Laid off !! Last day Sep 30th..what do I do ??

Guys, I got laid off. Last day, Sep 30th. I'm past the 6 months waiting period, now what ???
Questions (please answer !!)

A. I have Emp. Auth. Do I need to find a job or can I stay without a job for a couple of months (severance was good !) and then get a job ??

B. Do I need to notify INS now or just shut up and wait till they approve or RFE my case ?

C. Can I be an independant contractor ?

D. Get a new Lawyer ?

I'm in the same boat. I'm looking for a job desperately. My last day is also on Sept 30.

My consulting will pay a mx of 2 weeks bench pay.

Any GC veterans please answer.

I'm also going to be laid off as of Sep 31.

I just spoke to my lawyer and he says I need to get a letter
from my "next employer" stating that I have the same salary
and same title.

This means I cannot be a contractor or set up my own coporation
for consulting. Is this true?

Please advise!!!

As you guys have completed 180 days on ur 485, you shldn't have any problem.You still have 6 weeks left to find a job.

1. Start posting ur resume on all the major job serach sites like flipdog,monster,dice,careercentral,careerbuilder,computerjobs etc., It will take atleast 10 days to start getting responses.
2. Give ur cell as your contact no so that you will be always reachable.
3. If you plan to stick with ur consultant, fine. If not ask your lawyer whether you can continue with him if you leave the employer. If you are in good terms with ur employer assure him that you are leaving him just for GC sake and you might consider coming back to him later after u get ur GC.
4. Make sure you have ur EAD and while attending interviews and posting resume say that you are authorised to work for any employer in USA.
5. If possible, expand your geographical area of search and take up the closest one which you feel comfortable.
6. When u sign ur offer letter, u need t fill the I9 form and give a copy of EAD to your employer.

Anything else ??? I don't think so..

How do we get a letter stating salay and title in this case?

Make sure that you get a similar job. Salary should be in a similar range. Usually companies will be flexible in giving you a title. You have to provide these letters only in case you get a RFE. Otherwise, according to my lawyer, i do not have to inform INS about job change.

That's good info man ! but, tell me something, can I work on independant contracts ?? I'm a full time employee of a mobile apps. company (well, till sep 30th). What if I find 6-8 month contract jobs....?? I guess the problem comes up only when 485 is approved or rfe is sent..it looks like for my case, it will take another 5-6 months for any result but before that I will apply for another EAD extension and hopefully get a permanent employer.

what do you think ?
 
as long as the word 'temporary' is not mentioned in the employment letter , it should be fine. Also, i think the salary should be consolidated to annual rather than hourly. This is just my opinion. I am a hourly consultant and I had no other choice in this market. I thought I would rather take it than just wait for a permanent one. I will face whatever/whenever INS asks for. I am planning to ask my current employer for such a letter if I get a RFE/ local transfer. Why worry now ? Just keep doing whatever is best and leave the rest to God. You can only do whatever you can.

I agree with roran and he had given most sincere advice so far.

But, as an answer to one of my posting similar to the same
question asked...

I was told that When I am doing my GC with a particular employer, I am saying that I will work for him indefinitely. Anything I intend to do is a fraud. See the word intend.
So if you show your intention to change your employer, be a independent consultant or starting your own corporation , it is
definitely a problem.

SO, I was told not to post my Resume in monster. INS might not
have resources to check such sites. But it might still be risky..
If you start your corporation to be an independent contractor,
which means you will be talking to investers etc would also be risky.

I understand your point about independent contractor.

However, I do not agree that one should not post his resumes to DCIE etc. These sites are not only for contract jobs, but also for permanent jobs.

Is it a pre-AC21 scenario ? If AC-21 is indirectly asking to change job in similar area, how the following part of the above sentence would hold good :

I was in the same boat last year after I filed 485 I got layed off.

Get a new lawyer.. get sheela murthy

Sorry for the delay in answering your question. I had to do some emergency fire fighting at work...

Anyway, to answer your question. See the word intend.

You can definitely change jobs if you get laid off and stuff.
But as per INS rule, you should NOT HAVE THE INTENTION to change jobs during the process of GC. I know it is really dump.

But ,that is what I was told... Also H1B and GC are tied to the employer in order to fill up the IT positions as per demand. When you post your Resume in monster or dice, you are not in demand. Giving your cell phone (as someone sugessted) and your real identity might (only might...) create a problem, if INS tracks such things. That is probably why I was told not to post in monster...

I don't know... Anyway Good Luck... There is still demand for people with sound Technical skills. I am sure you will get one...
