Laid off in EAD with 485 pending for 2 months. Options?

If one is laid off after the EAD has been approved and 140/485 are pending for about 2 months, what are the options?

Does the GC process has to start from scratch?

AC21 says it should be atleast 180 days your 485 applications needs to be pending before you can change the employer. However if your current employer does not inform ins about your status , iam not sure how would ins find out that you changed the employer before 180 days.


Gurus need your input.
 
The only chance for you is if there is no RFE on your 140.If there is a RFE on your 140 then game over. So pray that your 140 is approved.

Also this is assuming that BCIS will not touch your 485 petition within 6 months(looking at the current processing times they will not).
 
my case similar, but my company shutdown, 1 month into filing 140/485 concurrent. i received receipt date and in a month time my company shut down.

they will not cancel my h1 or 140 or anything. but, i found a job in the same geog. location and i have requested the new employer to give the job designationa and job duties as similar to my gc job, so i can try ac21 in future if i get 140 approval and if 140 gets cleared.

please let me know, of your thoughts. any suggestion would be greatly appreciated. i hvent even got my ead yet.

do u think 140 will be denied and some how ins will know taht company shutdown? well our company is still there as an entity, i guess.
