Laid Off H1/EAD/140

Hi, I was recently laid off on Feb 25th 09. I have my H1B is valid till Jan 2011. Can I still transfer my H1B to new company without company paying me? How much time do I have to do this?

My 140 was denied and an appeal has been filed by attorney on April 9th which could take months to result ? Can I stay in US on that basis?

Can I start working on my EAD in above scenario?

If your 140 was denied, then your 485 and hence EAD is also denied for now. So you cannot work on EAD. H1 transfer will be very difficult without current pay slips, not impossible though. As a last resort, you can file H1 transfer without the request for I-94. In this case, if you get transfer approved, you will need to go out of the country and come back to get a new I-94.
